The Electric Mobility Code (Regulamento da Mobilidade Elétrica – RME) is based in the legal provisions for ERSE of the Article 31st and 41st of the Decree-Law No. 93/2025, of 14 of August, that establishes the legal framework applicable to the organization, access and exercise of activities related to electric mobility. This framework also aligns the national legal framework with the Regulation (EU) 2023/1804 of the European Parliament and of the Council of 13 September 2023 on the deployment of alternative fuels infrastructure (AFIR).
The RME applies throughout the national territory and regulates the activities of operators of recharging points (OCP) and Electric Mobility Service Providers (EMSP), in the context of providing information, price supervision, commercial relations, service quality, measurement, reading and provision of electricity data.
The RME also promotes the protection of the rights and interests of electric vehicle users in relation to prices and service quality, monitoring of the electric mobility market, the provision of information to entities involved in the electric mobility sector, and the contribution to improving the technical and environmental conditions of electric mobility activities.
The main addressees of the RME are:
- Operator of a recharging point (OCP), as entities responsible for the installation and operation of charging points and for providing a recharging service to electric vehicle users, including in the name and on behalf of a mobility service provider (EMSP),
- EMSP, that provides services in return for remuneration to an electric vehicle user;
- Network operators, as parties responsible by the electricity meters used for billing in the electricity sector and by the handling concerning consumption data,
- Electric vehicle users, as users of the electric mobility network,
- Charging point owners, as the owners of recharging points located on private property to which access is restricted to a limited and determinate group of persons
The RME in force was approved by ERSE Code no. 3/2025, of 22 of December, following the Public Consultation No. 135. Previous codes may be found in the Normative Acts of ERSE.
The Decree-Law No. 93/2025, of 14 of August, also establishes that the previous rules of functioning of electric mobility remain in effect, as option during the transitional period.

Pilot-Projects
The RME allows the development of pilot-projects. These projects should consider the following:
- They shall be submitted to ERSE
- They shall identify the provisions of RME that require derogation for the development of the project
- They must be approved by ERSE
- They must be monitored by ERSE and the results are of mandatory public disclosure
Pilot-projects aim to facilitate the development of innovative projects for which the rules are not always adjusted, which is especially relevant in a new sector and developing sector such as electric mobility.

Working Groups
RME allows ERSE to create working groups that contribute to deepen the regulation and to follow up on the technical nature of subjects regarding electric mobility, given its innovative nature and technological dynamism.
The working groups currently functioning are:
- The working group about direct current metering in charging points (PT)
- The electric mobility follow up group (PT)
Transitional period
Transitional period of function of the previous rules of electric mobility
The transitional regime stems from the provisions of Article 44 of Decree-Law No. 93/2025, of 14 of August, which established its duration until December 31st, 2026.
The RME applies to recharging points integrated in the electric mobility network platform during the maintenance of the transitional regime.
In addition to the above, the RME also deals with the following matters applicable for the duration of the transitional regime:
- Regulatory model to be applied to the electric mobility network management entity (EGME), including the method of revenue definition,
- Measurement, reading and handling concerning charging data,
- Revenues and regulated tariffs.
The transitional regime foreseen in RME also applies to EGME (Mobie.E) as the responsible for the managing of energy and financial flows and to the electricity suppliers for electric mobility (CEME) as users of recharging data for billing purposes.

- Directive no. 7/2022, of February 28 – procedures for reporting to ERSE the prices of commercial offers and average prices billed in the electric mobility network

- Norm ME 3/2022 – Information to disclose by the electric mobility management entity (EGME) regarding prices of operators of charging point (OPC) integrated in the electric mobility network (and excel template to be filled in)
- Directive no. 8/2020, of May 28, approves the General Conditions of the Contract for Adhesion to Electric Mobility Network and the calculation method for the bank guarantees to present to the electric mobility management entity (EGME)
Complementary rules of the activity of Management of Operations in the Electric Mobility Network, approved by the ERSE Administration Board, in the terms of Instruction no. 1/2023, of February 8, for regulatory information report defined in the Eletric Mobility Code:
- EGME – Norma financeira real, financeira previsional, quantidades reais, quantidades previsionais, 15 minutos reais e consumos médios reais/previsionais.
These are Excel files to be filled by Mobi.E (EGME) with financial, accounting and operational information, used to define the allowed revenues and tariffs.
