ERSE launches Public Consultation to regulate the new legal framework for electric mobility

ERSE – Energy Services Regulatory Authority launched a Public Consultation to regulate the new legal framework for electric mobility, which introduces significant changes compared to the previous legal framework.

The new framework was established by Decree-Law No. 93/2025 of 14 August and focuses on the provision of electric vehicle recharging services by:

·         recharging point operators, through ad hoc based charging, i.e. without the need for prior registration or contract by the end user, and

·         electric mobility service providers, ensuring the exchange of data and payments between various recharging point operators and the service provider from which the end user purchases a recharging service.

The commercial relationship model has been simplified, facilitating the use of local resources (self-consumption, storage) for recharging electric vehicles and providing services to the grid through smart charging and bidirectional charging.

The law also establishes the free choice of supplier for internal delivery points in consumption facilities not exclusively for electric mobility. With this option, an electrical installation (home, business or condominium garage) can have a second specific (internal) meter for recharging points and with a different supplier. This proposal regulates this option.

The current model, based on the Electric Mobility Management Entity and contracts with Electricity Suppliers for Electric Mobility, will remain in place on a transitional basis until the end of 2026, in parallel with the new forms of organisation for electric vehicle recharging.

Electric mobility has grown significantly in Portugal in recent years, with around 7,000 delivery points in the electricity sector with recharging stations, comprising approximately 13,000 public recharging points and 1,200 private recharging point owners connected to the electric mobility network. The number of electric vehicles has also grown in recent years, with around 357,000 electric vehicles at the end of the second half of 2025, 58% of which are battery electric vehicles and the remaining 42% hybrid plug-in.

ERSE's proposal put out for public consultation focuses on changes to the Electric Mobility Code, the Guide for Metering, Reading and Provision of Electricity Data of Electricity sector, the Code on Self-Consumption of Electricity and the Code on Quality of Service in the Electricity and Gas Sectors.

Comments from all interested parties are requested by 25 of November 2025.
